These terms apply to ImgSmith at https://xianshen.xyz. By using the site, you agree to them. If you do not agree, do not use the site. Questions can be sent to 2961884811@qq.com.
Permitted use
You may use the tools for personal and commercial image work, at no charge, for as long as the site is available. There is no account and no license key. You are responsible for the images you process and for how you use the results.
You must be at least 13 years old to use the site. If you are below the age of majority where you live, use it only with the involvement of a parent or guardian.
Your images remain yours
You retain all rights to the images you open in the tools and to the files you export. The site claims no ownership over them. Because processing happens in your browser, the operator does not receive a copy and does not need a license to store, display, or distribute your images.
If you choose to send a file by email as part of a support request, you give permission to open it for the purpose of answering that request. Do not send files you are not allowed to share. Email attachments are deleted when the request is resolved unless there is a reason to keep the correspondence.
Intellectual property in the site
The site's design, text, and original code are protected by copyright and belong to their respective authors. You may not republish the site's content as your own or use its branding in a way that suggests endorsement.
The full editor is based on miniPaint, which is released under the MIT License. The upstream copyright notice and permission notice are retained as the license requires. This site's version is modified, and those modifications are not endorsed by the upstream authors. The MIT license permits use, modification, and redistribution of the software; it does not grant rights to the site's separate branding or editorial content.
Third-party names and logos mentioned on the site belong to their owners and are used for identification only.
Acceptable use
You may not use the site to:
- Process or distribute illegal content, including content that infringes copyright, privacy, or other rights.
- Create or distribute sexual images of minors, or any content that exploits or endangers a child.
- Harass, threaten, or defame a person, or publish private information without permission.
- Remove or alter another person's watermark or rights-management information in order to misrepresent ownership.
- Upload or distribute malware, or attempt to interfere with the site's operation or security.
- Use automated requests in a way that degrades the service for others, or attempt to bypass a technical limit.
- Misrepresent the site's output as endorsed by the site operator or by the upstream miniPaint authors.
The tools cannot verify ownership or detect illegal content, because the files never reach a server. Compliance with these rules is your responsibility. Access may be restricted if the site is being used in a way that creates legal or operational risk.
No warranty
The site and its tools are provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. There is no guarantee that a tool will produce a particular file size, dimension, color, or visual result, that output will be free of errors, or that the site will be available without interruption.
Image processing depends on the browser, the device, and the file. Keep your originals. The operator is not responsible for a file that is lost when a tab is closed, for a result that does not meet a third party's requirements, or for damage caused by relying on an output without checking it.
Limitation of liability
To the maximum extent permitted by law, the site operator is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or business interruption, arising from the use of or inability to use the site. Because the tools are provided free of charge, the operator's total aggregate liability for any claim relating to the site is limited to the minimum amount required by applicable law.
Nothing in these terms excludes liability that cannot be excluded under applicable law, including liability for fraud or for death or personal injury caused by negligence.
Third-party services and links
The site uses third-party hosting and, when enabled, Google AdSense advertising. Those services have their own terms and privacy policies. Links to external sites are provided for reference; the operator does not control their content and is not responsible for it.
Changes to the service and these terms
Tools may be changed, suspended, or removed without notice. These terms may be updated to reflect a change in the service or the law. The date at the top of this page will change when they are. Continuing to use the site after an update means you accept the revised terms.
Governing law
These terms are governed by the laws of the jurisdiction in which the site operator is established, without regard to conflict-of-law rules. Disputes will be handled by the courts that have jurisdiction over that place, unless applicable consumer law requires otherwise.
